FarmWise Policies and Terms of Service

Please see below for our FarmWise Further Terms and Conditions and Privacy policy that are required to be acknowledged by any client as part of our processes. 

By accessing our website or using our services, you agree to these Terms and Conditions.

FarmWise Scope of Service

The FarmWise consultancy service is provided on the following basis to provide clients with:

  • Independent, confidential, science-based advice

  • Services in planning, budgeting, pasture/feed management, nutrient/environment plans, herd planning, HR support, and more

  • Agreements for employment, sharemilking, contract milking, animal/farm leases

No Financial Advice

a)      FarmWise consultants are not financial advisers under the Financial Advisers Act 2008. They do not provide investment advice or recommendations regarding financial products.

b)     You acknowledge that FarmWise consultants are not financial advisers (as defined in the Financial Advisers Act 2008) and they are not authorised to, and do not intend to, provide a financial adviser service (as defined in the Financial Advisers Act 2008).

c)      Professional investment advice from an appropriately qualified adviser should be taken before acquiring or disposing of any financial products.

Confidentiality

d)     All information shared during the consultancy will be treated as confidential and will not be disclosed to third parties without prior written consent, except as required by law.

e)      Any reports, recommendations, advice or other Information provided to You by FarmWise (FarmWise Reports) are prepared solely for use by You and must not be relied on in any way by any third party.

f)        All FarmWise Reports are confidential, and You shall not disclose any FarmWise Reports to any third party, except, subject to clause (e) Your employees, consultants, and advisers, as they may reasonably require, and as otherwise approved in advance by Us in writing (Third Party Recipients). You shall ensure that all Third-Party Recipients maintain an equivalent level of confidentiality.

Limitation on Liability

g)      FarmWise consultants have no authority to make any decisions about Your business and must not be construed or represented as having such authority.  

h)      In this regard any advice or recommendation provided by FarmWise consultants is made in good faith on the basis of information available to the FarmWise consultant.

i)        Source information may be obtained from either Yourself or third parties and as such may be unaudited as to its accuracy, reliability, completeness and currency. For this reason, neither FarmWise Ltd nor your consultant gives any warranty as to the accuracy, reliability, completeness of the advice or recommendations provided.

j)        Any advice or recommendation whether provided in writing or orally should in no way be considered a direction or requirement.

k)      Neither FarmWise Ltd nor the Consultant shall be liable for any indirect, incidental, or consequential losses / damages arising from the use of advice provided.

Client Responsibility

l)        You acknowledge that You must make Your own decisions and exercise Your own judgement when making any decisions regarding Your business activities, including where a FarmWise Report is provided to You. FarmWise Reports may not include sufficient information, recommendations or advice for You to make a decision. FarmWise recommends that You obtain professional legal, tax, accounting and business advice before making any decisions.

Termination and Payment Terms

a)      Except where a contract has been signed for specific activities the client may cease to utilise the services of their consultant at any time. Fees for services rendered up to termination date will remain payable.

b)     Payment will be due 20th of month following invoice unless agreed prior with your consultant in writing. For certain consultancy requests or new clients FarmWise consultants reserve the right to request payment either in part or full for services prior to or upon delivery.

Intellectual Property

c)      Any materials, reports, or tools developed during the consultancy remain the property of FarmWise or the Consultant unless otherwise agreed in writing.

 

Privacy Policy

FarmWise and its consultants will operate as required under the Privacy Act 2020 which governs how businesses and agencies collect, store, use, and share personal information.

a)      Information will be collected only for the purpose of providing consultancy advice relevant to your business requirements. This can include but is not limited to farm details, addresses and employment related information.

b)     This information may be collected from third parties, via direct access, forms, emails with your consent and or permission.

   i.      Where you provide third party access to accounts such as Ravensdown, Farm Source etc. you retain the right to remove such access at your discretion.

c)      Your consultant will take all reasonable steps to ensure your information is stored securely both digitally and in written form at all times. 

d)     You can request access or provide corrections at any time directly to your consultant.

e)      Data will be retained for its purpose and disposed of securely once no longer required or requested by yourself.

f)        FarmWise or your consultant will notify you as soon as practicable upon discovering any potential or actual breach of privacy.

g)      You can contact FarmWise at any time if you have any privacy concerns.
